A Queens mom blasted the judge who allowed her daughter's rapist to go free after he allegedly savagely attacked the 17-year-old victim again Monday, stabbing her and leaving her paralyzed from the waist down.
Daniel Paguay was charged with raping the mother of his child, Jaden, on April 21, and prosecutors requested $250,000 bond. Instead, Queens Supreme Court Justice Stephanie Zaro set bail at $25,000. Paguay was freed weeks later.
"It's not fair," railed the teen's mother, Evelia Leon, 41. "The judge should not have lowered his bail."
"How could he be out?" Leon complained to the Daily News as her daughter was being treated at Elmhurst Hospital Center. "He's crazy. Who would stab someone like that, especially the mother of his son?"
On Monday, Paguay, 20, dragged Leon's daughter into the Fine Fare supermarket in Corona, police said. He plunged a 10-inch blade into her back three times, authorities said. Minutes earlier, he stabbed his own cousin, Gabriel Calle, 20, who is now dating the teen victim, police said.
"Right now she's stable. She cannot speak or move," Leon said. "She can only sense you if you touch her hands."
Zaro, who issued the $25,000 bail in the rape case, ordered Paguay held without bail Tuesday on attempted murder, assault and weapons charges.
In a stunning move, the judge appeared to defend the earlier bail.
"He was out on a serious bail that I set on the rape charge," Zaro said in court.
Even before this week's attack, it appears the system failed the girl again.
Authorities said Paguay violated an order of protection on June 11 - exactly a month after posting the $25,000 bail.
She told police the ex-boyfriend broke into her apartment about 2 a.m., court records show.
Police didn't arrest him. And cops couldn't say Tuesday what attempts were made to find him after the break-in.
